Permit fees4 rules ▾
- Awarded proposer must pay all utility charges including gas, steam, water, electricity, sewer, and telephone
- Payment due to City must be paid in full for entire season on contract signing or in equal monthly payments
- Proposer must state fixed yearly amount willing to pay for concession rights
- Monthly fee payment required for food concession services privilege
Insurance2 rules ▾
- Insurance amount may be reasonably increased by Landlord as necessary to protect Landlord's interests
- Must secure combined automotive and public liability coverage of at least $1,000,000 combined single limit

- Proposals must be submitted in sealed envelopes with 10 complete copies and original signatures
- Proposals must be received by 10:00 AM on Friday, January 28, 2022
- Must submit Letter of Transmittal summarizing understanding of scope and naming authorized representatives

- Must provide qualifications and experience of service providers
- Must provide proposed plan explaining concession services and operations

Operating restrictions7 rules ▾
- Sale of items shall be made only at designated sites within the park
- Signs and their display locations must receive prior City approval
- Only removable shed type structures, mobile carts or vehicles allowed - no permanent structures
- Equipment must be moved from City property at the end of the season
- Operation must not interfere with public enjoyment through excessive noise or odor
- Must display menu boards on concession units and provide prompt, efficient, courteous service
- Activities must be conducted to render best possible service to public in dignified manner with no pressure or intimidation
Hours of operation2 rules ▾
- Vendors shall operate for 5 months from May 15, 2022 until October 15, 2022
- Operating hours shall not exceed 9 pm unless prior permission granted by City for special events
Eligibility4 rules ▾
- Late proposals, proposals without surety, without original signatures, or submitted via facsimile will not be accepted
- Applicant must declare they are the only interested party in the proposal
- Applicant must declare they have read and understood all conditions
- Must disclose any City employee conflicts of interest
Penalties3 rules ▾
- Non-performance includes failure to regularly provide services without specific reason or City Council approval
- Contract may be cancelled without cause by City with 30 days written notice
- Contract may be cancelled immediately for non-payment of fees or vendor non-performance

- Awarded proposer must establish and maintain utility connection between mobile food service trailer and premises
- Proposer must agree to save City harmless from all losses, costs, or damages caused by proposer's acts or agents
- City disclaims responsibility for injury to contractors, their agents or others; proposer shall be independent contractor
- City reserves right to waive proposal informalities and reject any proposals
- Price proposal weighted at 50% in evaluation criteria
- Qualifications weighted at 25% including equipment quality, experience, and responsiveness
- Plan of operation weighted at 25% including operational plan and menu reasonableness
- City reserves right to conduct interviews with proposers
- City reserves right to negotiate contract terms with selected vendor
- All contracts require City Council approval
